Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal ) Act, 2013.

    The supreme court of India recognized sexual harassment at the workplace as a violation of fundamental rights in its landmark Judgment in Vishaka vs State of Rajasthan and Others, 1997,6SCC page No.241.


    Acts of "unwelcome sexually determined behaviour" are said to be harassing when they are humiliating and may constitute a health and safety problem "in relation to (the victim's) employment or work". This means an implied or explicit promise of preferential treatment in her employment or implied or explicit threat of detrimental treatment in her employment and an implied or explicit threat about her present or future employment status, interference with her work, or creating an intimidating, offensive, or hostile work environment for her, as well as humiliating treatment likely to affect her health or safety.

    Dr Shanmugham is a member of the Internal Compliant Committee (ICC), as mentioned in the POSH ACT. He has a wide knowledge of the POSH Act and is an adviser for an educational institution, industries, and establishment.
